Denial of Rights. The case at hand is whether black parents are denied the right to make a contract, as defined by the 13th Amendment, by the policies of the schools. The Justice Department, in a brief filed by Solicitor General Robert Bork, argues in support of the decisions of the lower courts that such a denial of rights has occurred.
